1.4 Enquiries by email, telephone, or fax 

If you contact us by email, telephone, or fax, your inquiry, including all resulting personal data (e.g., name, inquiry), will be stored and processed by us for the purpose of processing your request and in the event of follow-up questions.

This data is processed on the basis of Art. 6 (1) (b) GDPR, provided that your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of inquiries addressed to us in accordance with Art. 6 (1) lit. f) GDPR or on your consent in accordance with Art. 6 (1) lit. a) GDPR, if this has been requested.

The data you send to us via contact requests or enter in the contact form will remain with us until you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). If this occurs, the data will be deleted. Mandatory legal provisions—in particular statutory retention periods—remain unaffected.

2.1 Purpose and legal basis

We collect data within the scope of:

  • Networking
  • Event management
  • Contracts
  • Inquiries
  • Quotes and invoices
  • Orders

The collection is carried out in accordance with Art. 6 (1) (a) – (f) GDPR.

2.2 Categories of personal data

Provided by you: name, company, address, telephone and fax numbers, email addresses, date of birth, gender, academic degree, and department/position. Additionally collected by e-mobil BW: CRM information (e.g., creation date, letters, emails, inquiries).

2.3 Source of the data

The data was collected by us and comes from the following sources: business card exchange, telephone calls, trade fair visits, publicly accessible sources, contact via email, third-party recommendations, inquiries from interested parties.

2.4 Data transfer to third parties, transmission, and profiling

We will only pass on your personal data to third parties within the framework of the statutory provisions. Unless you have explicitly consented to this in the context of a consent form. Any transfer to third parties is always for a specific purpose. There is no transfer to third countries (third country transfer) or profiling.

2.5 Storage period

Your data will only be stored by us within the legally permissible storage periods.

 

3. Note on events in accordance with Articles 13 & 14 of the GDPR

Please note that your personal data will be processed by Landesagentur e-mobil BW GmbH (hereinafter referred to as the organizer) and any co-organizers for the purpose of holding events (e.g., creation of my name tag, information about the booked event by email and telephone, invitations to events organized by e-mobil BW GmbH). We process the following data for this purpose:

  • Where applicable, title, job position, and function/department
  • Intuition or company
  • First and last name
  • Phone number (landline and/or mobile)
  • Email

This also includes the processing of your data by a service provider commissioned by the organizer or co-organizer and/or a digital service (e.g., Webex or Microsoft Teams) exclusively for the purpose of conducting the event. This processing is carried out in accordance with Art. 6 (1) (b) GDPR if you have previously voluntarily registered for the event.

We only store your personal data for as long as it is necessary to fulfill the purposes and no further legal retention periods prevent its deletion or its purpose has ceased to apply. In the event of an objection, we will no longer process your personal data.

3.1 Note on photo and film recordings

We would like to point out that at events (virtual or on-site), a service provider commissioned by the state agency e-mobil BW GmbH (hereinafter referred to as the organizer) (e.g., photographer, film crew) and/or employees of the organizer may take photographs or film for the purposes of documentation, press and public relations, and publication in various media (e.g., websites, radio, television, print, social media, etc.). Publication is carried out by the organizers and their cooperation partners (e.g., state ministries) on the basis of our legitimate interest (Art. 6 (1) (f) GDPR) in press and public relations work. You can revoke this processing of your personal data at any time with future effect in accordance with Art. 21 (1) GDPR. You can do this directly at the event by informing the service provider (e.g., photographer, film crew) or the moderator (in the case of virtual events). 3.2 Microsoft Teams

We use the Microsoft Teams video conferencing tool to hold online meetings or events with you. In accordance with Articles 13 and 14 of the GDPR, we would like to inform you about the processing of your personal data when using the Microsoft Teams video conferencing tool:

  • User data such as user or display name, email address, profile picture (optional), preferred language
  • When dialing in by phone: information about the incoming and outgoing phone number, country name
  • Test, audio, and video data, if exchanged via the chat function
  • Metadata such as IP address, time and location information
  • Technical data such as log data and log files

There are no specific plans to transfer your data to third countries. We have concluded an agreement with the provider of Microsoft Teams on order processing in accordance with Art. 28 GDPR. However, it cannot be ruled out that data may be routed via Internet servers located outside the European Union (EU). This may be the case in particular if participants are located in a third country.

The legal basis for data processing is Art. 6 (1) (b) GDPR, insofar as the meetings are held within the framework of contractual relationships. Art. 6 (1) (a) GDPR, if you have consented to participate in an online event. Insofar as the processing of personal data is an essential part of the use of Microsoft Teams, Art. 6 (1) lit. f) GDPR is the legal basis for data processing: We have a legitimate interest in conducting online meetings to simplify our business processes and in conducting online events for public relations purposes.

As a rule, our meetings or online events are not generally recorded. In exceptional cases, recordings are possible. However, you will either receive a corresponding announcement in the invitation and/or you will be notified at the latest at the beginning of the event before the recording.

Data stored in connection with the use of Microsoft Teams is generally deleted after 30 days. In individual cases, this may be up to 180 days.

The Microsoft Teams video conferencing tool is part of Microsoft Office 365. 3.3 Webex

We also use the Webex video conferencing tool to hold online meetings or online events with you. In accordance with Articles 13 and 14 of the GDPR, we would like to inform you about the processing of your personal data when using the Webex video conferencing tool:

  • User information: first name, last name, telephone number (if applicable), email address, profile picture, organization
  • When dialing in by phone: Information about the incoming and outgoing phone number, country name
  • Test, audio, and video data, if applicable, when exchanged via the chat function
  • Metadata such as IP address, time and location information
  • Technical data such as log data and log files

There are no specific plans to transfer your data to third countries. We have concluded an agreement with the provider of Cisco Webex Meetings on order processing in accordance with Art. 28 GDPR. Information on which data is processed by Cisco Webex Meetings and for what purposes can be found in the Cisco Webex Meetings privacy policy. Your data may also be processed by Cisco Webex Meetings on servers outside the EU. However, it cannot be ruled out that data may be routed via Internet servers located outside the EU. This may be the case in particular if participants are located in a third country.

4. Website

When you use this website, various personal data is collected. The following privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done. We would like to point out that data transmission over the Internet (e.g., when communicating by email) can have security gaps. It is not possible to completely protect data from access by third parties.

4.1 SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. 4.4 Server log files

Our website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are: browser type and browser version, operating system used, referrer URL, host name of the accessing computer, time of the server request, IP address. This data is not merged with other data sources. The basis for data processing is Art. 6 (1) lit. f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website—for this purpose, the server log files must be collected.

 

5. Other external website elements/plugins

5.1 Matomo

Matomo is analysis software from InnoCraft Ltd, 7 Waterloo Quay PO625, 6140 Wellington, New Zealand. The software is initially deactivated. Only when you actively consent will we collect your usage behavior anonymously.

The following data is collected for this purpose:

  • Anonymized IP address/user ID, if applicable
  • Date and time of access, as well as time in the local user's time zone and geolocation
  • Referrer URL, URL and name of the page accessed and page access time
  • Files that were clicked on and downloaded (downloads)
  • Web browser and operating system of the end device, as well as screen resolution used
  • Links to an external domain that were clicked on
  • User agent and main language of the browser used

We would like to use Matomo to further improve our website and adapt it to the respective needs of our users. The information collected about your use of the site will not be passed on to third parties. The legal basis for data processing is based on your consent in accordance with Art. 6 (1) (a) GDPR. The above-mentioned data will be deleted as soon as it is no longer required for our purposes. The statistics generated and the underlying data will not be deleted, as these are purely statistical values – it is not possible to establish a personal reference.

5.2 Friendly Captcha

Our website uses the "Friendly Captcha" service provided by Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee, Germany. Friendly Captcha is a new, privacy-friendly protection solution that makes it more difficult for automated programs and scripts (so-called "bots") to use our website. To this end, we have integrated a program code from Friendly Captcha into our website, for example for contact forms, so that the visitor's device can establish a connection to the Friendly Captcha servers in order to receive a calculation task from Friendly Captcha. The visitor's device solves the math problem, which uses certain system resources, and sends the result to our web server. The server contacts the Friendly Captcha server via an interface and receives a response indicating whether the puzzle was solved correctly by the device. Depending on the result, we can apply security rules to requests made via our website and, for example, process or reject them.

  • The data is used exclusively for the protection against spam and bots described above.
  • Friendly Captcha does not set or read any cookies on the visitor's device.
  • IP addresses are only stored in hashed, i.e., one-way encrypted form and do not allow us or Friendly Captcha to identify an individual.
  • If personal data is stored, this data is deleted within 30 days.

The legal basis for processing is our legitimate interest in protecting our website from malicious access by bots, including spam protection and protection against attacks such as mass requests in accordance with Art. 6 (1) (f) GDPR.

5.8 DeepL

This website uses an extension from the provider DeepL to translate website content on e-mobilbw.de. DeepL is a translation service provided by DeepL SE, Maarweg 165, 50825 Cologne (hereinafter "DeepL").

No connections to DeepL are established when visiting the website. This means that no personal data of visitors is transferred to DeepL. Only the web server of "e-mobilbw.de" is connected to DeepL, delivers all content via the content management system, and receives the fully translated content back. All translated content is stored locally on the web server, so that even foreign-language entries (e.g., in the search function, contact form, etc.) do not lead to data being transferred to DeepL, but are only processed locally.

6. Social media

We maintain accounts, pages, or channels on the networks listed below in order to provide you with information and offers within social networks and to offer you additional ways to contact us. The legal basis for this is Art. 6 (1) (f) GDPR. We have a legitimate interest in presenting our offerings on selected social media platforms.

Data we receive from you and process:

If you contact us via direct message, we generally process your username, which you use to contact us, and may store other data you provide, if necessary, to process/respond to your request. The legal basis for this is Art. 6 para. 1 lit. a) and b) as well as f) GDPR. There is a legitimate interest in the effective processing of inquiries addressed to us.

(Statistical) usage data that we receive from social networks

We automatically receive statistical values regarding our account via certain functionalities. The statistics include "likes," information on page activities and post interactions, reach, video views, and information on the proportion of men/women among our followers.

Data that social networks process about you:

You do not need to be a member of the social network to view the content of our accounts. Please note that social networks process data even when accessed without a user account. Cookies and similar technologies are also used for this purpose, over which we have no influence. Details can be found in the privacy policy of the respective social network. If you want to interact with the content on our accounts, you must first register with the respective social network and provide personal data. It cannot be ruled out that your data may also be stored outside the EU and passed on to third parties.

6.1 YouTube

This website features videos from the "YouTube" platform, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). The operator of the video platform is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066 US, a subsidiary of Google.

We use YouTube to optimize our services and to better present our work. When using YouTube, the following data is processed: IP address, contact details, data about your user behavior, and device information. Due to the fact that YouTube also processes data in the US, among other places, we must inform you of this.

6.2 Social media wall: Stage.bio

On our "social media wall," you will find the latest content from our activities on LinkedIn. We use Stage.bio for this purpose. Stage.bio is a service provided by Jaimo Solutions GmbH, Friedrichstraße 52, 76669 Bad Schönborn. As a social wall, Stage.bio collects our posts from LinkedIn, displays them chronologically, and shows them to the user. The social media content is stored on German servers and played back from there without cookie consent, tracking analysis, or advertising.

The use of Stage.bio serves to ensure transparency with regard to our public relations work. Social media content can be made accessible to interested parties without having to use social media channels. There is no direct connection to social media channels. The posts can be viewed in a data protection-friendly manner without logging in or registering. When using Stage.bio, no personal data of the user is stored, no software analysis tools are used, and no evaluation of personalized user behavior takes place. The content provided via Stage.bio is continuously optimized for barrier-free use.
